Construction Supervisor Given Six Months for Asbestos

Douglas Greiner, a construction supervisor from Boise, Idaho, was given six months of home confinement for his role in failing to supervise asbestos removal at a construction site. According to sources, Greiner was responsible for the removal of asbestos from a town called Orofino, and did not dispose of an asbestos-laden pipe as he should have. Along the way to move the pipe to another site, soil at some sixteen different sites was contaminated with asbestos from the asbestos-laden pipe – subjecting others to an asbestos risk and scare. There is a twist in the story, however: Greiner did not give bad instructions, nor did he lead those over whom he was in charge to do something illegal; instead, he was sentenced in court “to ensure that there will not be any leniency when it comes to the safe disposal of toxic and hazardous materials.” Asbestos is a carcinogen, a cancer-causing agent, and consists of small fibers that make their way into someone’s lung by way of t he gener al air flow, or through inhalation of fibers. Once inhaled, these fibers lodge themselves in the throat and travel to the lungs – where they can breed lung cancer some 30 to 40 years down the line. Thus, it is no small thing to fail to supervise asbestos removal. The fact that some 16 other sites were contaminated with asbestos is even more troubling. One of the rules of asbestos removal is to make sure that the risk of exposure to asbestos is minimal. By failing to supervise, Greiner neglected to alert those who removed the asbestos to eliminate the amount of exposure that other citizens could have to the fibers – knowing that the pipe was “laden” with asbestos. If someone has a blood disease of some kind, would you not educate that person to watch out for others and make sure that they don’t cut themselves and pass their blood on to others? If a person has mononucleosis (mono for short), would the doctor not tell the individual and those whom the indiv idual is around mo st to have his or her own individual cups, plates, spoons, and forks – and to see to it that no utensils or cups are shared between them? These are things that you would expect someone to tell sick individuals and those they are around most of the time, in order to prevent further sickness and tragedy. Asbestos Removal Failure to supervise led to the asbestos fibers floating in the air, meaning that others could inhale them and suffer from mesothelioma many years down the road – all because Greiner failed to instruct in the area where it mattered most. That is why the EPA is cracking down on these cases: to send a message that, should one person get mesothelioma, we have all failed to do our jobs – including the EPA.

Mesothelioma Cancer Genetic Link Discovered

NIH-funded researchers discover genetic link to mesotheliomaIdentified gene mutation may underlie other cancer types Scientists have found that individuals who carry a mutation in a gene called BAP1 are susceptible to developing two forms of cancer  mesothelioma, and melanoma of the eye. Additionally, when these individuals are exposed to asbestos or similar mineral fibers, their risk of developing mesothelioma, an aggressive cancer of the lining of the chest and abdomen, may be markedly increased. The study, published online Aug. 28, 2011, in Nature Genetics, describes two U.S. families with a high incidence of mesothelioma, as well as other cancers, associated with mutations of the BAP1 gene. The research was funded by the National Cancer Institute (NCI), part of the National Institutes of Health, and led by scientists at the University of Hawai i Cancer Center, Honolulu, and Fox Chase Cancer Center, Philadelphia. Mesothelioma tumors are typically associated with asbestos and erionite exposure. Erionite, a naturally occurring mineral fiber similar to asbestos, is found in rock formations and volcanic ash. Deposits have been located in at least 12 states. Only a small fraction of individuals exposed to erionite or asbestos actually develop mesothelioma, one of the deadliest forms of cancer that kills about 3,000 people each year in the United States, with half of those diagnosed dying within one year. Additionally, rates of new cases of mesothelioma in parts of the world, including Europe and China, have risen steadily over the past decade. “This discovery is a first step in understanding the role of the BAP1 gene and its potential utility when screening for mutations in those at high risk,” said Michele Carbone, M .D., Ph.D., study co-leader and director of the University of Hawaii Cancer Center. “Identifying people at greatest risk for developing mesothelioma, especially those exposed to dangerous levels of asbestos and erionite worldwide, is a task made easier by virtue of this discovery.” Joseph R. Testa, Ph.D., study co-leader and Carol and Kenneth E. Weg chair in Human Genetics at Fox Chase Cancer Center, added, “This is the first study to demonstrate that individual genetic makeup can greatly influence susceptibility to mesothelioma. People exposed to dangerous levels of asbestos or erionite, those with a strong family history of mesothelioma, or those who have been previously diagnosed with a rare tumor of the eye known as uveal melanoma, may benefit from this new discovery.” The study found evidence that some people with BAP1 gene mutations also developed breast, ovarian, pancreatic or renal cancers, suggesting the gene mutation may be involved in multiple cancer types. On ly about 10 percent of women with an inherited risk of breast or ovarian cancer carry mutations in the genes BRCA1 or BRCA2, which are known to be associated with those diseases. Consequently, some inherited risk of breast and ovarian cancer may stem from mutations in BAP1 genes. “Also, it appears likely that other genes, in addition to BAP1, will be found to be associated with elevated risk of mesothelioma,” said Testa. The researchers first suspected that mutations in the BAP1 gene might underlie mesothelioma in people with a strong family history of the disease after noticing genetic changes in or near other stretches of DNA where the BAP1 gene is located. Looking more closely at two families with unusually high rates of mesothelioma, they saw that every person who had provided a sample and had developed mesothelioma or melanoma of the eye also carried mutations in the BAP1 gene. Further investigation led to sequencing the gene in 26 individuals who had developed mesot helioma but did not have a family hist ory of the disease. Tumors from about 25 percent of this group carried mutations in the BAP1 gene, and in two cases the mutations were inherited. Both of the individuals with inherited mutations had previously developed melanoma of the eye. “The discovery that the BAP1 gene is involved in a new cancer syndrome characterized especially by uveal melanoma and mesothelioma provides yet another example of the critical importance of the detailed genetic analysis of human tumors,” said Donald Blair, Ph.D., NCI. “Such analysis can lead to the discovery of genes involved in the same tumors that arise spontaneously. Nurse Develops Malignant Mesothelioma

An ex-nurse who is suffering from a deadly asbestos-linked disease is requesting anybody who had worked together with her to come forward with details regarding the hospitals where she worked between 1960s and 1970s.

Kalliopi Copley, a Wickersley (Rotherham) resident, was diagnosed in 2012 November with malignant mesothelioma, a deadly cancer of the mesothelium. This is a cancer caused by one’s exposure to or inhalation of asbestos fibres and dust.

Copley thinks she might’ve got in touch with asbestos material while working as trainee nurse at Rotherham-based Moorgate Hospital and Doncaster Gate Hospital (the first hospital in the town of Rotherham), part of Rotherham Nursing School, between 1966 and 1969.

She is able to recall dealing with asbestos material at the Northern General Hospital, a large teaching hospital in Sheffield, where she worked for almost 16 years as a matron.

Copley is undergoing radiotherapy at present a t the We ston Park Hospital, a dedicated cancer hospital in England. She has asked attorneys to help her realize how the dangerous mineral was used earlier in the hospitals. All those hospitals were undergoing major renovations during that time, she says. Copley wants to find out whether more could’ve been done for protecting her.

Copley said when she was being trained at the Doncaster Gate and Moorgate hospitals, she’d to walk past the renovation work each day, but she was never ever warned that asbestos was present in the site and informed how hazardous it is. She said she was more directly involved in the Northern General Hospital’s redevelopment. She had to see the work’s progress at that site.

Copley said she hopes her colleagues, including nurses, doctors and other hospital employees, would help her by providing information regarding how asbestos might’ve been used in hospitals and thus to get a few answers regarding how she developed a t errible disease like mesothelioma.

Martyn Hayward, an attorney with prominent law firm Irwin Mitchell, is representing Copley in this case. He said he hopes as many of his client’s colleagues and friends who was there with her when she was working at Doncaster Gate, Northern General and Moorgate hospitals would come forward with vital information soon so that his law firm can help Copley fight and win the justice that she deserves.

The testosterone therapy lawsuit purports that this type of marketing ultimately failed to protect AndroGel users from the serious side effects of the testosterone replacement medication. The news release issued by the law firms that filed the complaint says this is the first testosterone replacement therapy class action in Canada. U.S. Court records indicate that there are currently over 150 testosterone lawsuits pending litigation and AndroGel lawsuits continue to be filed while in the testosterone multidistrict litigation in the Northern Illinois federal court. In June, an AndroGel lawsuit was filed under MDL 2545 on behalf of a 72-year-old Texas man who alleges he suffered a significant myocardial infarction, or heart attack, in November 2005 as a result of being prescribed AndroGel in January 2005. The testosterone lawsuit further purports the myocardial infarction caused severe physical and emotional injuries, which affected th e man’s personal and profe ssional life. In addition, the testostoerone therapy complaint contends that the defendants, AbbVie and Abbot Laboratories, knew or should have known that AndroGel created significant risks of serious bodily harm and they failed to adequately warn consumers and health care providers about those risks. In July, Health Canada issued a warning about the potential life-threatening heart and blood vessel risk linked with testosterone products after completing a safety review of the prescription drugs. According to the Canadian regulatory agency, Andriol, Androderm, AndroGel, Axiron, Delatestryl, Depo-Testosterone, Testim and their equivalent generics are among the 12 products that contain testosterone that are currently marketed in Canada. The FDA said their decisions to reassess the safety of these drugs were based on two separate studies. The first study published in November 2013 by the Journal of the American Medical Association (JAMA) suggested that men who were prescribed testosterone medication as part of the study were at a 30 percent increased risk of stroke, heart attack, and death. The second study published in the PLOS One Journal January 29, 2014, found an increased risk of heart attack in olde r men, and in younger men with pre-existing hear t disease, who filled a prescription for testosterone treatment. Mesothelioma Cancer Genetic Link Discovered

NIH-funded researchers discover genetic link to mesotheliomaIdentified gene mutation may underlie other cancer types Scientists have found that individuals who carry a mutation in a gene called BAP1 are susceptible to developing two forms of cancer  mesothelioma, and melanoma of the eye. Additionally, when these individuals are exposed to asbestos or similar mineral fibers, their risk of developing mesothelioma, an aggressive cancer of the lining of the chest and abdomen, may be markedly increased. The study, published online Aug. 28, 2011, in Nature Genetics, describes two U.S. families with a high incidence of mesothelioma, as well as other cancers, associated with mutations of the BAP1 gene. The research was funded by the National Cancer Institute (NCI), part of the National Institutes of Health, and led by scientists at the University of Hawai i Cancer Center, Honolulu, and Fox Chase Cancer Center, Philadelphia. Mesothelioma tumors are typically associated with asbestos and erionite exposure. Erionite, a naturally occurring mineral fiber similar to asbestos, is found in rock formations and volcanic ash. Deposits have been located in at least 12 states. Only a small fraction of individuals exposed to erionite or asbestos actually develop mesothelioma, one of the deadliest forms of cancer that kills about 3,000 people each year in the United States, with half of those diagnosed dying within one year. Additionally, rates of new cases of mesothelioma in parts of the world, including Europe and China, have risen steadily over the past decade. “This discovery is a first step in understanding the role of the BAP1 gene and its potential utility when screening for mutations in those at high risk,” said Michele Carbone, M .D., Ph.D., study co-leader and director of the University of Hawaii Cancer Center. “Identifying people at greatest risk for developing mesothelioma, especially those exposed to dangerous levels of asbestos and erionite worldwide, is a task made easier by virtue of this discovery.” Joseph R. Testa, Ph.D., study co-leader and Carol and Kenneth E. Weg chair in Human Genetics at Fox Chase Cancer Center, added, “This is the first study to demonstrate that individual genetic makeup can greatly influence susceptibility to mesothelioma. People exposed to dangerous levels of asbestos or erionite, those with a strong family history of mesothelioma, or those who have been previously diagnosed with a rare tumor of the eye known as uveal melanoma, may benefit from this new discovery.” The study found evidence that some people with BAP1 gene mutations also developed breast, ovarian, pancreatic or renal cancers, suggesting the gene mutation may be involved in multiple cancer types. On ly about 10 percent of women with an inherited risk of breast or ovarian cancer carry mutations in the genes BRCA1 or BRCA2, which are known to be associated with those diseases. Consequently, some inherited risk of breast and ovarian cancer may stem from mutations in BAP1 genes. “Also, it appears likely that other genes, in addition to BAP1, will be found to be associated with elevated risk of mesothelioma,” said Testa. The researchers first suspected that mutations in the BAP1 gene might underlie mesothelioma in people with a strong family history of the disease after noticing genetic changes in or near other stretches of DNA where the BAP1 gene is located. Looking more closely at two families with unusually high rates of mesothelioma, they saw that every person who had provided a sample and had developed mesothelioma or melanoma of the eye also carried mutations in the BAP1 gene. Further investigation led to sequencing the gene in 26 individuals who had developed mesot helioma but did not have a family hist ory of the disease. Tumors from about 25 percent of this group carried mutations in the BAP1 gene, and in two cases the mutations were inherited. Both of the individuals with inherited mutations had previously developed melanoma of the eye. “The discovery that the BAP1 gene is involved in a new cancer syndrome characterized especially by uveal melanoma and mesothelioma provides yet another example of the critical importance of the detailed genetic analysis of human tumors,” said Donald Blair, Ph.D., NCI. “Such analysis can lead to the discovery of genes involved in the same tumors that arise spontaneously.
