Lincoln Alliance Building Renovation Plan Collapses Due to Asbestos Dispute

A $22 million renovation plan for the Lincoln Alliance Building collapsed because of asbestos problem. Now the destiny of the historic building is uncertain.

According to the buyers, they were not informed regarding the amount of asbestos present in the building at 181-187 E. Main St. They say removing the dangerous material will cost in excess of $2 million. But the seller says it is just a fabricated and overstated excuse for providing an out for a fiscally inept development team.

Doug Sutherland, the owner of Franklin Properties, a Syracuse-based development company, said they do not have a project.

City Council had granted a low-interest loan of $3 million for Sutherland and his partner Patrick Dutton to start the work. But the money was not disbursed because the deal in no way closed.

Sutherland said they needed an addition $2 million. Per the purchase agreement, Conifer Alliance, the seller, has the onus to reveal the asbestos issue, Sutherland said. “It did not happen, whatever may be the reason,” Sutherland said.

Asbestos is a deadly substance that can cause diseases like lung cancer and asbestosis. Renovation is possible only after removing the substance because it can be more dangerous if disturbed.

Forest Officials Check for Asbestos at Aspen Cabin

Aspen, CO – Forest officials are now checking whether a structure has asbestos inside. This is being done as part of assessing how to remove the carcasses of cows discovered inside a cabin.

The normal procedure to remove the carcasses is to use explosives or to incinerate the cabin. These procedures can be dangerous if asbestos is present in the structure. Asbestos is a known carcinogen.

According to rangers, cows wandered into the cabin in a snowstorm and then failed to find the way to go out. The Carcasses were discovered by cadets in the Air Force Academy in 2011 March while snowshoeing.

Steve Segin, a spokesman with the Forest Service, said timeline has not been set to determine how to dislodge the carcasses.

Normal School to Get Rid of Asbestos

Normal – The initial phase of removal of asbestos will begin May 1 at a junior high school building in central Illinois. The school has been closed for the remaining school year.

The estimated cost of the renovation project at Chiddix School is $3.2.

The school was closed in last February as the Department of Public Health in Illinois suggested sealing 10 classrooms and conducting extensive air quality tests.

The renovation project includes replacing existing ceilings, lighting, carpeting and furniture. The project also includes asbestos abatement.

The work is expected to be completed by the time school reopens in the fall. Asbestos cleanup has to be completed by 4th June.

Former Mechanic Develops Malignant Mesothelioma

A couple is suing responsible companies for causing one of them to develop mesothelioma, a terminal cancer of the lining of lungs and the abdominal and chest cavity.

David and Judith Hall have filed a complaint recently in St. Louis Circuit Court.

According to the complaint, David Hall was working as a mechanic in Kansas, Colorado and Washington in the 1960s until 1970s. He also worked as a construction worker and as a home remodeler during the same period, according the suit.

The plaintiffs say David Hall was exposed to asbestos and asbestos products during his work. The defendant companies didn’t warn him regarding the risks associated with asbestos exposure. They didn’t provide him with sufficient safety equipment either, the complaint says.

The plaintiffs are seeking compensation from the companies for causing his present condition.

Couple Seeks Jury Trail to Resolve Asbestos Claims

Charleston – A Chesapeake (OH) couple has filed a asbestos lawsuit against 95 corporations, claiming that the companies are liable for an asbestosis diagnosis.

The complaint filed by Glen Roy Jones and his wife Florence Jones say Mr. Jones was diagnosed with the asbestos disease in 2010 March.

Jones worked with ACF Industries as a laborer, lift operator, truck driver, storekeeper and material inspector from 1963 to 1986, the complaint says.

The companies failed to warn Jones regarding the hazards of exposure to asbestos products, according to the lawsuit. The couple argues that the companies failed to provide Jones with adequate safety equipment while working with and around asbestos products.

The plaintiffs are asking for a jury trial to resolve the issues.

Mesothelioma Kills New Jersey School Principal

Tragic news from New Jersey: Briarcliff Middle School’s 39-year-old principal Marco F Cera died after developing malignant mesothelioma.

Marco was brought up in the same region where he became an educationalist. After changing professions from time to time, he became a teacher of social studies and eventually the principal at Briarcliff Middle School in 2010.

Marco was diagnosed with mesothelioma in 2011 August. It is still not known the reason for that diagnosis and how he had been exposed to asbestos. The only known reason for mesothelioma is inhalation of asbestos fibers.

Marco’s father Anthony Cera said he faced the cancer heroically.

“Marco believed he could defeat it and he lived that way,” Anthony Cera said.

Though the use of asbestos has been limited now-a-days, it was a very common construction material before 1972. For this reason, almost all old school buildings contained asbestos as they were built. Though some of them removed and replaced the substance, many old school buildings still contain asbestos. So, still many school students and teachers are at the risk of developing deadly asbestos-related diseases such as mesothelioma and asbestosis.

Building Owner Pleads Guilty to Asbestos Violations

A building owner in Ohio has pleaded guilty to charges of disposing of hazardous asbestos.

Lorne Elbert and his firm Elbert Building had been indicted on charges by Environmental Protection Agency (EPA) that the company illegally removed asbestos from a city building it owns.

In 2007, Elbert worked with an authorized asbestos contractor after receiving a quote of $4,900 to eliminate around 800 sq. ft. of asbestos-containing insulation from the boiler room in the building prior to its demolition. He informed the Ohio EPA that his firm would engage the licensed company for asbestos removal job. But, he actually used an individual who didn’t have a license to handle asbestos-related jobs to save money.

Inspectors with the EPA discovered four drums containing dry asbestos. In addition, asbestos fibers were found in the parking lot and boiler room.

Street Sections Reopen after Asbestos Concerns

St. Louis – Crews have removed asbestos off a downtown block, according to city officials.

The Lucas Avenue and 11th Street (North) sections, which had been closed following a steam pipe break released asbestos fibers into the air, were reopened following health director Pam Walker said the test results confirmed there were no dangerous levels of asbestos.

The pipe ruptured last week sent a steam cloud above downtown streets, carrying fibers from asbestos insulation with it. The city shut the streets and started swabbing surfaces for asbestos fibers.

Results of surface test indicated the presence of asbestos all through the one-block portion southwest of the pipe rupture. However, air monitors have not discovered airborne asbestos fibers, according to Walker.

The north of Lucas Avenue will remain closed until the ruptured pipe is repaired. According to officials, it may take up to 10 days.

Governor Vetoes Bill to Limit Successor Liability in Asbestos Litigation

A bill, which would limit the legal responsibility of successor companies in asbestos-related cases, has been vetoed by Minnesota Governor Mark Dayton.

The bill will protect companies that acquired asbestos manufacturing firms from lawsuits in the future under the supposition that the company was just an innocent successor and therefore should not be held liable for the individuals suffering from asbestos-related health issues.

However, many DFL members opposed the idea of providing protection to companies from future litigation for known as well as unknown responsibility. The Minnesota Association for Justice also contested the bill.

The bill limits the liability of the company in potential asbestos claims only up to the original company’s gross assets’ reasonable market value, as of the day the companies consolidated or merged. The bill will also protect other corporations that acquired firms that manufactured asbestos prior to 1972, the year that asbestos was identified by the government as a health hazard.

Couple Says Occupational Asbestos Exposure Caused Lung Cancer

Charleston – A couple from Ripley has filed a lawsuit against 58 companies, claiming that the defendants are liable for an asbestos-related lung cancer.

Gay Williams was diagnosed with Asbestos-related lung cancer on January 25, the suit filed on 22nd March in Kanawha Circuit Court says.

According to the plaintiffs, Williams was exposed to deadly asbestos and asbestos products all through his employment as a laborer between 1966 and 2005.

The defendant companies didn’t warn Williams regarding the hazards of asbestos while negligently exposing him to the cancer-causing substance, the couple says.

The plaintiffs ask for a court trail to resolve the issues. A visiting judge has been assigned the case.
